Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the StarGutti mobile game, website, and related services (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be legally permitted to use the Services where you live. If you are below the age of legal majority, a parent or guardian must review and agree to these Terms for you. You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account.

2. License to use StarGutti

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for lawful, non-commercial entertainment. StarGutti and its software, artwork, designs, logos, game systems, content, and other materials are owned by or licensed to us. No ownership rights are transferred to you.

3. Fair play and acceptable conduct

You agree not to:

• Cheat, collude, manipulate matches or rankings, deliberately lose, exploit bugs, or use bots, scripts, automation, modified clients, or unauthorized tools.
• Harass, threaten, impersonate, defraud, or abuse another person, or use offensive account names or content.
• Access another person’s account, share or sell accounts, evade a suspension, or misrepresent your identity or eligibility.
• Reverse engineer, copy, modify, distribute, scrape, disrupt, overload, or attempt unauthorized access to the Services, except where law expressly permits it.
• Use the Services for unlawful gambling, money laundering, fraud, or any illegal purpose.

We may investigate suspected violations and take proportionate action, including removing results or rewards, restricting features, suspending, or terminating accounts.

4. Matches, rankings, and availability

Matchmaking, rankings, statistics, and results are determined by our systems and game rules. Network interruptions, maintenance, bugs, player disconnects, or security reviews may affect a match or result. We may correct clear errors, invalidate compromised matches, adjust rankings, and change features or rules to protect fairness and improve the Services.

5. Leagues, promotions, and rewards

Some leagues, competitions, or promotions may offer rewards and may be subject to additional displayed rules, eligibility requirements, schedules, territories, verification, and payout procedures. Where additional rules conflict with these Terms, the specific rules control for that event.

• Rewards are earned only after results and eligibility are verified. Displayed pending rewards are not final payment obligations.
• We may require identity, age, location, tax, or payment verification where lawful and reasonably necessary.
• Participants are responsible for taxes, fees, and legal obligations associated with rewards unless applicable rules state otherwise.
• Rewards may be withheld or cancelled for cheating, collusion, fraud, duplicate accounts, ineligibility, payment errors, or violation of these Terms.
• StarGutti competitions are skill-based game features. They must not be used for unauthorized wagering or gambling.

6. Advertising and third-party services

The Services may display advertisements or link to third-party products and services. We do not control and are not responsible for third-party content, availability, terms, or privacy practices. Your dealings with third parties are between you and that third party.

7. Updates and service changes

We may update, add, remove, suspend, or discontinue features, content, events, or the Services. Updates may be required to continue playing. We aim to keep StarGutti available but do not guarantee uninterrupted or error-free operation.

8. Suspension and termination

You may stop using the Services at any time. We may restrict, suspend, or terminate access if you violate these Terms, create risk or legal exposure, or threaten the fairness or security of the Services. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—will continue to apply.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. Nothing in these Terms excludes rights that cannot legally be excluded.

10. Limitation of liability

To the fullest extent permitted by law, StarGutti and its owners, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, rewards, or opportunities arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid us for the Services in the 12 months before the claim or the minimum amount required by applicable law.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless StarGutti and its owners, affiliates, and service providers from claims, losses, liabilities, and expenses arising from your misuse of the Services, your violation of these Terms, or your infringement of another person’s rights.

12. Governing law and disputes

These Terms are governed by the laws applicable in the place where the StarGutti operator is established, without regard to conflict-of-law rules, except where the mandatory consumer laws of your location apply. Before filing a formal claim, please contact us and allow 30 days to attempt an informal resolution. Nothing here prevents either party from seeking urgent protective relief or using a consumer forum available by law.

13. Changes to these Terms

We may update these Terms when the Services, game rules, or legal requirements change. We will post the updated Terms here and change the effective date. Continuing to use the Services after updated Terms take effect means you accept them, where permitted by law.

14. General terms

If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms, the Privacy Policy, and any event-specific rules form the entire agreement regarding the Services.
